Eddie - on your flow chart/ timeline... wasn't there a Toy Fair in there somewhere where Moose revealed their designs/ announced the new line?  I remember you posted something a few months ago along with a pic - it was some show or something.  

 

Am I not remembering something correctly?

 

Anyhow - I wish you the best of luck with the line.  And I hope the cream rises... and your line succeeds.  I know this biz can be cut throat, but I believe you and your talents!!

I don't see how this could get anywhere in court or anything. It could be argued both lines are just updated Food Fighters. I mean,a talking slice of pizza has been done 100 times.

I do believe they stole Eddie's idea but unfortunately the little guys can't fight these big companies.

Its true. Legally I have no leg to stand on. They are scumbags to me and I no longer work with them.

My your'e an angry one.  ok...

 

A fan made home crafted figure.... no license needed.

 

A majority of booths at Comic con would not be able to be there if they all needed licenses to sell images or products off the comic character. It comes down to money. Is it worth them suing me for selling 5 or 6 figurines of their character. I seriously doubt it. Fan art keeps characters relevant and alive. This is why Marvel and DC dont upset their fans by coming down on them unless its a huge commercial item.

 

As for Neal Adams..

Did he pitch me the idea for Bucky o Hare and ask me to make mini figures and I refused and said I dont make minifigures? But then went about producing them anyway cutting him out of hunderds of thousands in royalty??  No...that did not happen, So its not the same situation between Moose and Myself.

Lol... I love you, dude.  But I think scale matters!  No one is saying a bootleg isn't a bootleg - and yes copyright infringement is wrong.  HOWEVER, I think the scale and the implications matter, and as such I think it's unfair when comparing it to the whole Moose Toys/ Snack Attack thing.

 

Considering you separated the thread last time - as the rest of this thread unfolds, it may be better suited to be on the "intellectual property thread" that you started earlier.

 

(for whatever my opinion is wroth lol...)

One thing at a time...

1. I'm not angry. I find the obliviousness of hypocrisy to be marginally amusing at best, but I mainly see the value in trying to open discussions on the topic of IP appropriation. Which brings me to-

2. Neal Adams isn't Disney or Warner Brothers. He is an artist, not a corporation, and it's his invention that is being coopted... which brings us to-

3. It being something, that after your most recent experience with Moose, I would have thought you to be more sensitive or at least self aware of.

I think you are a talented artist, and would love to see you find success with your craft. I just don't understand how you have internally justified your use of other people's appropriated work while you get frustrated about it being done to you.

So everyone on here is a thief who has made a custom figure of someone else's character?  Also I don't see creators like Alienrobotmonster giving credit to Matt and Ross Duffer, creator of Stranger Things. Its a fan made mini figure dude not a million dollar project.

For the record, I never said there was a difference. My opinion, and I seem to be in the minority here, is that at the very least, the creators SHOULD at least, AT LEAST, get credited. It takes three seconds to add that text shoutout to a social post, or packaging for the figure.
Fan made minis for profit, aren't the same as doing a one off as a personal use or even commissions. You can't NOT understand this.

People not giving credit when basing something (obviously) off someone elses work doesn't mean they're doing things right, big business or the little guy. It might be flattering to some, but not to everyone. Especially if they're not credited in the process - which kind of defeats the purpose of making a run of fan art available. Not everyone is going to know it's fan art to begin with, what it might be from, or in some cases what generation it might be.

 

So a majority of booths are doing commissions and fan art at cons, still doesn't make it right... and some DO need licenses. Most don't give a crap because of the same thing you brought up, a larger corp actually suing them would be near worthless on the corps part, and many are just dandy with being sent a C&D order as a warning. A lot of other, legit industry folk that have ties to some of the comics that they may be doing drawings of can legally do fan art from them in many cases.

Just this morning I found Neal Adams sleeping on a bench at the park,and he was mumbling something about being a rich man if only he'd been cut in on the mini figure profits. I felt bad so I gave him 5 bucks to do a Batman head sketch on my Starbucks cup.

Completely unrelated - but kinda not... 

 

In Burbank on Magnolia which is a street I frequently drive on, there is a little studio with a "Continuity Video" sign.  It's in the same shape and font as Neal Adams' Continuity Comics from back in the day.  It's been there for as long as I can remember and while it looks like whatever was there has been closed a long time, I have always wondered about it.  Perhaps Adams' tried to get some of his creator owned stuff off the ground (besides Buck that is...) or who knows maybe it's a carry over from Bucky's 5 mins of fame!!

How have I never seen this?

If you are heading AWAY from Burbank towards NoHo and it's shortly after you pass Hollywood Way... it is on the left hand side.  Shortly past the BBQ place.  It's pretty small and black and white on a Brown one story strip building...

 

Check it out the next time you go that direction!  

 

I've got a gig over there tomorrow - perhaps I'll try and snap a pic denoting on how tired I am.
