So, Sunday, I got hit by an uninsured driver. The collision totaled my car, and made me a sore, grumpy dude. Now, after looking into it, in my state, there really isn't a whole lot that can be done about it. I could sue him, but it would wind up costing more than the car, and he could just file bankruptcy and never pay (thus rendering it an exercise in futility).

Any suggestions on how to legally motherf**k this guy?

There isn't one.  Same goes for illegal immigrants with NO liscence OR insurance if you get smashed by one of them.  Just screwed.  Yeah, unlawful people may go to jail or get hit with something legally- but- like they care, right.

People that do abide the laws get screwed by people that do not abide by the laws.  That seems the American Theme.  The Dream is gone.

Let me clarify: Obviously, suing the guy won't work.

He's still going to get motherf**ked, I just want to stick it to him in a way that isn't going to land me in jail... So no "setting his car on fire", et al.

haha...good luck brother.  Find out where they live and trip on their sidewalk right in front of their house?  Ask to use their bathroom and do the ol' slip and fall?  That's about your options.

I just can't believe it's legal to drive without insurance...I mean that irresponsibility can ruin others because you don't want to or cant afford it or whatever reason. If you cant be a responsible driver take the bus man.....seriously though I wouldn't drive through his house lol..

I mean, it's NOT legal... It's just that on a civil level, there aren't a lot of salient options for pursuing it legally.

you should be able to get his address fairly easily......knife his tires till you're satisfied with the monetary value, make sure you get a knife with teeth to make the tire totally not usable by slicing a big slit in just 3 tires leaving one perfectly normal every time.....why 3 tires? because it's super funny, and he'll pretty much always have to buy 4 anyway

.....nevermind, you said legally mothereff this guy.....YOU CANT. here in tennessee is the same way...people all day long with no car insurance and if they hit ya, you're screwed.....these same folks wouldn't have anything for you to sue and own anyway....why would you want their shack in a settlement. i hate PEOPLE

Is it not a criminal offence? If that happened here, the perpetrator would currently be kicking his heels in a police cell.

This part of the american law is just bullshit... similarities here with too low penalties on shit.. especially the mildness of sex offender penalties suck. Thats why most take justice to their own hands when this happens, perfectly just in my oppinion.

...And justice for all

To hell with buying a $500 car... Just rent one and max out all the insurance they offer you! And THEN drive it into his house! ; )
(I be the doesn't have home owners insurance either lol...)

Or if he is t a home owner... Wait about a month or so until his car is fixed, or he gets a new car and then ram the rental into newly fixed car. You're covered. He's not. JUSTICE!

Tally up a total. Take him to small claims court for $3000 (limit) or whatever the car was worth. You will win the judgement. Then either look into having his wages garnished yourself or sell the judgement to a collections office. They will certainly garnish his wages.

Maybe you can also sue him separately in small claims for bodily injury.

Next time though, make sure you have uninsured motorists coverage so that when some idiot does this, you are covered.

I can't speak for every state, but Texas does not garnish wages except in rare circumstances, usually only if the government is the one seeking the judgment. My family had a similar incident to IronMask many years ago, and we got diddly thanks to Texas' awful laws.

Well, I looked into it, and there are a few companies that specialize in buying settlements, and pursuing the settlements on their own. That might be a salient option.
